Felony charges against Jackson Mahomes, the younger brother of NFL star Patrick Mahomes, may be dropped as prosecutors claim that the alleged victim is no longer cooperating. The Johnson County, Kansas District Attorney’s Office filed a motion to dismiss all charges against Mahomes on Tuesday.
According to court documents obtained by TMZ, prosecutors representing the restaurant owner who accused Jackson Mahomes of forcibly kissing her inside her Overland Park business in February 2023, now claim that she does not wish to move the trial forward. She reportedly wants “the matter to be dismissed as to anything involving” her.
Although the alleged victim does not want to proceed with the case, prosecutors argued that the incident was captured on surveillance footage. However, the alleged victim reportedly stated that she had not been truthful to the police and that the encounter with Mahomes was consensual.
A judge is expected to make a ruling on the motion to dismiss during a hearing on Wednesday. If the charges are dropped, the case would be reduced to one misdemeanor battery charge. It is worth noting that Mahomes allegedly shoved a waiter at the restaurant on the same day as the alleged incident involving the owner.
Mahomes’ attorney, Brandon Davies, stated in a statement to FOX 4 KC that Jackson has done nothing wrong and that they had full confidence that the truth would come out. Davies added that the defense would reserve further comment until the remaining count is disposed of.
The 23-year-old Mahomes pleaded not guilty to the charges when they were initially filed and has been out on bond since May. The outcome of the upcoming hearing will determine the future of the case against him.
